Privacy Statement

This Privacy Statement describes the ways in which the Program on Negotiation at Harvard Law School (“PON”) gathers and uses personal information about individuals through the PON Website (https://www.pon.harvard.edu), and in the course of program registration, program activities, and program inquiries.

Users

This Privacy Statement applies to participants in PON programs and events, persons who have expressed an interest in PON, and visitors to and users of the Website regardless of current relationship to PON.

Information Gathering

The personal information about individuals that may be collected by PON includes:

  • Name
  • Business and personal email and mailing addresses
  • Business and personal phone numbers
  • Employer, work title, field of work
  • Countries/cultures where worked
  • Nationality
  • Gender
  • Previous negotiation training
  • Information on English proficiency
  • Accommodations needed for services (if any)
  • Payment information (credit card information or bank information)
  • Image (still or video)
  • Data on program attendance, participation and activity by individuals, including negotiation exercises
  • Individual self-assessments, feedback, survey responses on programs and exercises

The Website also generates log files of the IP addresses and browsers of computers accessing the Website and the pages visited.

Use of Information

The personal information is used for:

  • Responding to inquiries
  • Enrollment in PON programs and payment processing
  • Delivering programs and related content and training, including surveys of participants
  • Maintaining participant records and providing completion certificates
  • Internal assessments of PON programs and internal training
  • Research, such as research on negotiation practices and negotiation education (may involve outside collaborators)
  • Distributing information on PON events and resources
  • Website improvements

All program sessions and accompanying chats are recorded for PON internal use such as training. Recordings may include a participant’s name, likeness, voice, and appearance during program sessions.

PON will use individual contact information to prepare and distribute a directory to program participants. Individuals have the opportunity to opt out of the program directory.

The personal information may also be used for PON internal reporting and analytics, including course statistics.

PON may review users’ IP addresses and data on the Website files and resources that users access to administer the Website and to provide technical support and help diagnose problems. PON may use and retain email or other communications to technical support staff in order to process inquiries, respond to requests, and improve service.

PON may share program data with Harvard Law School, which exercises administrative and fiscal supervision over PON activities, and otherwise internally within Harvard University.

PON may use, share  and disclose personal information if PON believes that doing so is necessary or appropriate to: satisfy any applicable law, regulation, legal process or governmental request; investigate compliance with or enforce this statement and other PON terms and conditions; detect, prevent or otherwise address fraud, security or technical issues; or protect, defend or enforce the operations, property, rights and safety of users, PON and Harvard University, Harvard affiliates, or others.

Sharing of Information

PON engages Zoom, Canvas and other third-party vendors to support the data uses described in this Privacy Statement, including website hosting and maintenance, program enrollment and delivery, payment processing, maintaining records, surveying participants, responding to inquiries, and distributing information about PON and its programs. PON shares personal information with such third-party vendors as needed for these purposes.

PON is not responsible for the privacy practices or the content of third-party websites.

Forums and discussion groups offered by Canvas or through other third-party tools are usually not private. Information that users provide in such settings may be read, collected, and used by all others who access them.

We may use cookies and related technologies (“Cookies”) to gather information when users navigate through the Website, in order to enhance and personalize the experience, to help provide services available through the Website, to analyze Website usage, and to help improve the Website and our services. Some third parties may also use Cookies on our Website to collect information about your online activities over time and across different websites you visit. This information may be used by third parties to provide advertising tailored to your interests on other websites, apps and services you visit. There are security measures in place to protect against the loss, misuse and alteration of the personal information that is under PON’s control. Unfortunately, no online data transmission or storage can be guaranteed to be completely secure and PON cannot ensure or warrant the security of any information you transmit to us.

If you are located in the European Union, Iceland, Liechtenstein or Norway (the European Economic Area), or in the United Kingdom, Harvard’s Additional EEA Privacy Disclosures (https://gdpr.harvard.edu/eeaprivacydisclosures) may apply to your data in connection with certain PON programs.
