The Role of Consent in Mediation

To what extent does consent matter in mediation? What role does consent play in the decision to mediate? What role does it play in the choice of a mediation style or approach? Are there different considerations when lawyers are involved in mediation? Panelists will examine these and other questions.

Jacqueline Nolan-Haley is a Professor of Law at Fordham University Law School where she is the Director of its ADR and Conflict Resolution Program and Mediation Clinical Program. She has written extensively about informed consent and justice issues in mediation.
 
Dwight Golann is a Professor of Law at Suffolk University Law School where he teaches mediation and negotiation. He is an experienced commercial mediator, and has written and spoken widely on dispute resolution topics.
 
Frank E. A. Sander is the Bussey Professor of Law, Emeritus at Harvard Law School. He is a leading expert on alternative methods of dispute resolution and is one of the pioneers of the field. Among other innovations, one of his early papers put forth the idea of the "Multi-Door Courthouse," a court system that helps direct disputants to the most appropriate route to resolution.
