Interesting conflict item with a client I met with today for a lease renegotiation. The leasing agent acted as dual agent in the original lease and is also part owner of the property leased. In addition to that, his company manages the property for a fee that is part of my client's (lessee) C.A.M. monthly fees. These things were disclosed, but it's hard to imagine that he could practice equal fiduciary responsibility to both principals in that instance.
